Seizure of Vehicle on repeat offence of “using mobile while driving”


The High Court of Himachal Pradesh in CWP No. 1916 of 2009 and CWP No. 7784 of 2010 has identified the Use of Mobile Phone while driving as a driving hazard and major cause of accidents. Authorities concerned have been directed to take strict action and also maintain a database of the violators. If a person is found driving the vehicle while using the cell phone second time, his vehicle can be seized and shall not be released except with the permission of the court. As part of the follow up of the above directions, the Distt. Police Shimla prepared a record of such offenders. The following ten vehicle drivers have been found guilty of using mobile phone while driving for the second time:

The owners of these vehicles are being issued notices under Sec. 133 MV Act individually to surrender these vehicles with the Traffic Control Room, Distt. Police Shimla within stipulated time as prescribed in the notices issued to them or else their vehicles will be impounded on the spot as and where recovered.
